Confirm eligibility before comparing prices
A C corporation owner who is a bona fide eligible employee may be offered an individual coverage health reimbursement arrangement, or ICHRA. The owner should first confirm participation eligibility and the employer’s adopted terms. Partners, sole proprietors and more-than-2% S corporation shareholders should not assume the same employee treatment. Once eligibility is established, the next decision is how the offer interacts with Marketplace premium assistance.
The IRS premium tax credit questions and answers explain that an ICHRA offer can prevent premium tax credit eligibility. An unaffordable offer generally requires opting out before the individual can claim a credit, assuming other requirements are met. Accepting reimbursements and claiming Marketplace assistance are therefore not independent choices that can always be combined.
Compare two hypothetical household budgets
Suppose the owner’s individual policy premium is $700 monthly and the employer offers a $350 monthly ICHRA amount. Before other considerations, accepting the offer leaves $350 monthly for the owner to fund, or $4,200 over twelve months. Assume a separate Marketplace projection shows a potential $450 monthly credit if the individual is eligible and properly opts out of an unaffordable ICHRA. That alternative would leave $250 monthly, or $3,000 annually, under the assumed policy price.
The $1,200 annual difference is only a planning comparison. It does not establish that the offer is unaffordable or that the owner qualifies for the projected credit. The actual affordability calculation uses the applicable benchmark and year-specific rules, and household income affects credit eligibility. Obtain the required inputs before treating either illustration as an available choice.
Collect the offer and Marketplace information
Keep the employer notice, offered reimbursement amount, eligible months and any required opt-out instructions. Obtain the applicable premium and household information for the affordability analysis. The premium for the policy the owner prefers may not be the benchmark used by the rule. A benefits platform’s informal savings estimate should not replace the actual calculation and supporting records.
If the household applies for Marketplace coverage, accurately disclose the employer offer. Preserve the application responses and any eligibility determination. A founder may know about the company’s arrangement long before the Marketplace receives updated information. That timing gap can produce advance credits that later need reconciliation. Assign responsibility for updating the application when the offer, employment or household income changes.
Document acceptance or opt-out before claims begin
Follow the plan’s procedure for accepting the arrangement or opting out. Record the effective date and eligible months. If the owner opts out to pursue Marketplace assistance, do not submit reimbursement claims through the employer portal for the same period without reviewing the consequences. A single premium reimbursement can undermine an assumption used in the personal credit calculation.
Coordinate payroll and the administrator so they know the election status. If reimbursements were paid in error, preserve the payment and correction history rather than silently removing the claim. The owner’s personal tax file needs to show what coverage and benefits were actually available and received. A clean year-end portal screen does not necessarily describe the facts that existed when advance credits were paid.
Reconcile the annual result
At tax time, compare the ICHRA election history, Marketplace statements, household income and any reimbursements. Explain changes in offered amounts or eligible months. The founder’s business may have changed compensation late in the year, affecting the household projection even though the health policy stayed the same. Keep those income changes connected to the credit reconciliation.
This article does not determine affordability, establish that a particular owner is an eligible employee or calculate the final premium tax credit. The employer arrangement, individual facts and current rules control. The useful decision is to evaluate the employer offer and Marketplace assistance together before accepting reimbursements. That prevents an owner from budgeting both benefits as though they were automatically additive and then discovering a personal tax adjustment after the coverage year has ended. Preserve the annual offer even if no claims were submitted, because the existence and affordability of the offer can matter independently of the amount the employer ultimately actually reimbursed. Record the monthly election history alongside the annual offer.
